Agree to Terms

 

These Terms constitute a binding agreement between You and Workerbridge Inc. or the Workerbridge company operating the Web site for the country in which you live or in which business is headquartered (“Workerbridge”) and are deemed accepted by you each time that you use or access Workerbridge. If you do not accept the Terms stated here, do not use the Workerbridge site.

 

Workerbridge may revise these terms at any time by posting an updated version to this web page. You should visit this page periodically to review the most current Terms because they are binding on you.  Users who violate these Terms may have their access and use of Workerbridge suspended or terminated, at Workerbridge discretion. You must be 18 years of age or older to visit or use any Workerbridge Site in any manner, and, if under the age of 18 or the age of majority as that is defined in your jurisdiction, must use Workerbridge under the supervision of a parent, legal guardian, or other responsible adult.

Workerbridge authorizes you, subject to these Terms, to access and use the Workerbridge site and the Workerbridge Content.  The contents of Workerbridge, such as designs, text, graphics, images, video, information, logos, button icons, software, audio files and other Workerbridge content, are protected under copyright, trademark, and other laws. All Workerbridge Content is the property of Workerbridge. The compilation (meaning the collection, arrangement, and assembly) of all content on the Workerbridge Sites is the exclusive property of Workerbridge and is protected by copyright, trademark, and other laws. Unauthorized use of the Workerbridge Content may violate these laws and/or applicable communications regulations and statutes and is strictly prohibited. You must preserve all copyright, trademark, service mark and other proprietary notices contained in the original Workerbridge Content on any authorized copy you make of the Workerbridge Content.

You agree not to sell or modify the Workerbridge Content or reproduce, display, publicly perform, distribute, or otherwise use the Workerbridge Content in any way for any public or commercial purpose, in connection with products or services that are not those of the Workerbridge Sites, in any other manner that is likely to cause confusion among consumers, that disparages or discredits Workerbridge, that dilutes the strength of Workerbridge or its licensor’s property, or that otherwise infringes Workerbridge or its licensor’s intellectual property rights. You further agree to in no other way misuse Workerbridge Content. The use of the Workerbridge Content on any other application, web site or in a networked computer environment for any purpose is prohibited.

You are responsible for maintaining the confidentiality of your account, profile, and passwords, as applicable. You may not share your password or other account access information with any other party, temporarily or permanently, and you shall be responsible for all uses of Your Workerbridge Site registrations and passwords, whether or not authorized by you. You agree to immediately notify Workerbridge of any unauthorized use of your account, profile, or passwords

 

The following is specific to the Trade Worker but must be read by the Contractor as well to fully understand the terms and conditions.

 

Trade Worker:  When you click “Agree to terms” you agree that Workerbridge is a scheduling tool to assist with your job search.  Workerbridge is not your employer and is not responsible to provide any benefits, insurance coverage, or anything typical or common to an employer relationship.    

You agree that there is a Time frame to return an offer.  The offer you received from Workerbridge will be active on your account by default for 24 hours.  You must respond to the offer in 24 hours, or your name will be removed as a potential candidate.  The contractor has the right to remove the offer at any time.  The contractor has the right to refuse employment of a trade worker after an offer has been accepted by the Trade worker.  Workerbridge does not guarantee that the offer you received will result in your employment.  The Trade Worker has the right to refuse any employment after acceptance of an offer.  Final employment terms and conditions are provided by the contractor/employer that you contract with.  Workerbridge is a tool for you to use to align yourself with potential employers and is not your employer.  The Trade Worker is responsible to maintain their personal calendar and to ensure that the days available for work are accurate.  It is the Trade Workers responsibility to contact the Contractor if the Trade Worker must end the project short of the accepted days.  It is the contractor’s responsibility to notify the Trade Worker if the accepted days are cut short so the Trade Worker can open those days for potential employment.

Workerbridge reserves the right to reject any trade worker from using the site if malicious intent is recognized.  The Trade Worker will be notified upon a Workerbridge decision to cancel their account.  Malicious intent can be but is not limited to; using the site for matters other than personal employment, knowingly filing false available workdays, etc.…  

You agree that Workerbridge cannot be held responsible for the safety of a job site.  All job site accidents and any resulting litigation is solely the responsibility of the Trade Worker and the Contractor. 

Any Profile you submit must be accurate and describe you, an individual trade worker or contractor. The profile requires standard fields to be completed and you may not include in these fields any telephone numbers, street addresses, email addresses or other means of contacting you.  You acknowledge and agree that you are solely responsible for the form, content, and accuracy of any information or material contained therein placed by you on the Workerbridge Sites.

 

The following is specific to the Contractor but must be read by the Trade Worker as well to fully understand the terms and conditions.

Final employment terms and conditions are provided by the contractor/employer after contacting the Trade Worker.  Workerbridge is a tool for you to use to align yourself with potential Trade Workers and is not an employer.  The Contractor is responsible to maintain their personal calendar and to ensure that the offered days of employment are true.  It is the Trade Workers responsibility to contact the Contractor if the Trade Worker must end the project short of the accepted days.  It is the contractor’s responsibility to notify the Trade Worker if the accepted days are cut short so the Trade Worker can open those days for potential employment.

Contractor and Trade Worker

 

You understand and acknowledge that You have no ownership rights in your account and that if you cancel your Workerbridge account or your Workerbridge account is terminated, all your account information from Workerbridge, including profiles, questionnaires, etc.… will be marked as deleted in and may be deleted from the Workerbridge databases and will be removed from any public area of the Workerbridge sites. Information may continue to be available for some period because of delays in propagating such deletion through the Workerbridge web servers. In addition, third parties may retain saved copies of your Information that you provided.

Workerbridge reserves the right to delete your account and all your Information after a significant duration of inactivity.

Workerbridge does not represent or guarantee the truthfulness, accuracy, or reliability of user content, derivative works from user content, or any other communications posted by users nor does Workerbridge endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk.

Workerbridge act as, among other things, venues for (i) Contractors to post job opportunities and search for and evaluate Trade Workers and (ii) Trade Workers to post available days and profiles.  Workerbridge does not screen or censor the listings, including profiles offered. Workerbridge is not involved in, and does not control, the actual transaction between Trade Worker and Contractor. As a result, Workerbridge is not responsible for user content, the quality, safety or legality of the Contractors or Trade Workers posted, the truth or accuracy of the listings, the ability of Contractors to offer job opportunities to Trade Workers or the ability of Trade Workers to fill Contractor Offers and Workerbridge makes no representations about any jobs, profiles, or user content on the Workerbridge site. While Workerbridge reserves the right in its sole discretion to remove user content from the Workerbridge site from time to time, Workerbridge does not assume any obligation to do so and to the extent permitted by law, disclaims any liability for failing to take any such action.

Workerbridge provides a venue for Contractors and Trade Workers to network for professional purposes and Workerbridge does not screen or censor the profiles or user content on the Workerbridge site. Workerbridge is not involved in the actual communications between users. As a result, Workerbridge has no control over the accuracy, reliability, completeness, or timeliness of the profiles or user content submitted on the Workerbridge site and makes no representations about any profile or user content on the Workerbridge site.

You assume all risks associated with dealing with other users with whom you come in contact through Workerbridge. By its very nature other people’s information may be offensive, harmful, or inaccurate, and in some cases will be mislabeled or deceptively labeled. We expect that you will use caution and common sense when using Workerbridge.

Because User authentication on the Internet is difficult, Workerbridge cannot and does not confirm that each user is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on Workerbridge, in the event that you have a dispute with one or more users, You release Workerbridge (and our agents and employees) from claims, demands and damages (actual and consequential and direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes to the fullest extent permitted by law

 

TO THE FULLEST EXTENT POSSIBLE BY LAW, WORKERBRIDGE DOES NOT WARRANT THAT ANY WORKERBRIDGE SERVICE WILL OPERATE ERROR-FREE OR THAT WORKERBRIDGE IS FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF WORKERBRIDGE RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA OR ANY OTHER COSTS, WORKERBRIDGE IS NOT RESPONSIBLE FOR THOSE COSTS. THE WORKERBRIDGE SITE IS PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. WORKERBRIDGE, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. WORKERBROIDGE MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE WORKERBRIDGE CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND LINKS.

TO THE FULLEST EXTENT POSSIBLE BY LAW, IN NO EVENT SHALL WORKERBRIDGE, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON THE WORKERBRIDGE SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE WORKERBRIDGE AND THE WORKERBRIDGE CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WORKERBRIDGE IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

You agree to defend, indemnify, and hold harmless Workerbridge, its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any User Content or other material you provide to Workerbridge, (ii) Your use of any Workerbridge Content, or (iii) Your breach of these Terms. Workerbridge shall provide notice to you promptly of any such claim, suit, or proceeding.

If you use Workerbridge through a mobile device, you agree that information about your use of the Workerbridge site through your mobile device and carrier may be communicated to us, including but not limited to your mobile carrier, your mobile device, or your physical location. In addition, use of Workerbridge through a mobile device may cause data to be displayed on and through your mobile device. By accessing Workerbridge using a mobile device, you represent that to the extent you import any of your Workerbridge data to your mobile device that you have authority to share the transferred data with your mobile carrier or other access provider. In the event you change or deactivate your mobile account, you must promptly update your Workerbridge account information to ensure that your messages are not sent to the person that acquires your old number and failure to do so is your responsibility. You acknowledge you are responsible for all charges and necessary permissions related to accessing Workerbridge through your mobile access provider. Therefore, you should check with your provider to find out if Workerbridge is available and the terms for these services for your specific mobile devices.

These Terms will remain in full force and effect while you are a user of Workerbridge. Workerbridge reserves the right, at its sole discretion, to pursue all its legal remedies, including but not limited to removal of your user content from the Workerbridge and immediate termination of your registration with Workerbridge, upon any breach by you of these terms or if Workerbridge is unable to verify or authenticate any information You submit to the Workerbridge registration. Even after You are no longer a user of Workerbridge, certain provisions of these Terms will remain in effect.

Workerbridge collects information about you and uses this information to help you connect with contractors and trade workers and to provide other services to you. This policy describes how your information is collected and used and your choices with respect to your personal information. We encourage you to review our privacy policy for detailed information on our privacy practices.

 

Scope of this Policy

This policy applies to information we collect or use on sites and applications owned or controlled by Workerbridge, Inc. Workerbridge is not responsible for the privacy policies or practices of ad networks and other websites, third parties with whom we work to provide you personalized services, or those who access your information on our sites or applications.

 

Information We Collect

We collect information about you when you use Workerbridge. We collect information directly from you such as your contact information, skills, and profile information. We also collect information about you automatically such as how you use and interact with Workerbridge, your demographic information, and information about your computer or mobile device.

How We Use Information

We use the information we collect about you to deliver the products and services we offer, respond to you, and operate and improve our sites and applications. Our services include showing you personalized content and advertising on Workerbridge or other sites with which we have a business relationship. We may use your information to contact you about Workerbridge updates, conduct surveys, or to provide informational and service-related communications, including important security updates.

Information you share in public areas of Workerbridge or make visible in profile database may be accessed, used, and stored by others around the world. We strive to provide a safe environment by attempting to limit access to our database to legitimate users, but we cannot guarantee that unauthorized parties will not gain access. We also cannot control how authorized users store or transfer information you give to us, so you should not post sensitive information to Workerbridge.

 

How We Share Information

We do not share contact information with third parties for their direct marketing purposes without your consent.

We may share information to third parties if you consent. For example, we may use your information to contact you about products or services available from Workerbridge.  If you opt in, we may supply your information to third parties who may contact you about their products or services. We disclose information where legally required.

We may disclose and transfer information to a third party who acquires any or all of Workerbridge business units.

 

How We Store Information

We store your information to make your interaction with Workerbridge more efficient, practical, and relevant. You may access, review, correct, update, or delete your skills or profile any time by signing into your account.

When you delete your personal information, we will retain logs and non-personal information about your activity on Workerbridge. We will also retain an archival copy of your information which is not accessible by you or third parties on the Internet. If your personal information was previously accessed by others using Workerbridge, we are unable to delete the information from their systems.

 

Other Information

Workerbridge is not intended for children under 18 years of age.

Workerbridge offers mobile applications.  Workerbridge collects and uses information about you as described in the Workerbridge privacy policy.
